The person who leaked the information is responsible, but ultimate responsibility lies with the person's employer, which is why hospitals fire employees who violate HIPPA confidentiality rules.
In this age of electronic records, of course it is possible for theft or misuse of patient's information. Happens all the time, in fact, I am sorry to say.
