Answers:

At this point, there are very few regulations on herbal manufacturing and sales. A few things you need to be aware of before you start are:

1) You must create your own product from scratch. You cannot take other companies' products and mix them to make your own. Most companies have some sort of markers or identifiers in their products so they know when other companies are stealing their products and marketing it under a different name. Often, it is an inactive, non-harmful ingredient that is unique to that particular company. If they find you are using their product for your own production and sales, you will have a huge lawsuit on your hands.

You can certainly buy fresh herbs from a person or company that grows them....but you need to manufacture the rest yourself.

2) You will have to set up your business with the state (or city....however it works where you are). If you are selling your product, you will have to pay taxes on your profit, so you will need a Tax ID number, and keep careful records so the IRS doesn't audit you for tax evasion.

3) Make sure you are careful about your product claims. Some states are very lax in their rules on what distributers claim their product does, while other states are very strict. If you claim it is for a medicinal purpose in the strict states, you can be brought up on charges of practicing medicine without a license. You need to go to your local health licensing agency to find out what the rules are where you will be selling your product so you stay in compliance with the law.
