What r my rights?!


Question: I have been going 2 therapy 4 about 5 years dealing with different issues. A few times I have had 2 change therapist. But its been all good. Recently I got a new therapist. I liked my old one but hey things happen. Well dude started tripping. Saying I need 2 b committed. He actually called emergency against my consent. I went n for my regular session n guy calls emergency! They take me 2 the hospital n I walk out. Guy did not stop there. He sent the police 2 my home! 3 squad cars 2 pick up one little me. Of course I didn't turn myself n. I've had several different therapist over the past 5 years. None of them never did any crap like that! Dude signed a petition 2 have them attempt 2 pick me up! I am like u got 2 b kidding! Can he do that? Of course I'm never going back. I thought it was on a voluntary basis only. Yet he just sign a sheet of paper all the while telling me it is 4 my own good. Is this really legal?

Wow, I recently had a similar experience. I'm bi-polar and had been doing ok for years with therapy etc then I changed town and had a depression and my new therapist contacted a psychiatrist and the shrink sectioned me under the compulsory mental health act and put me into hospital!!!

Yes, they can do it! It sucks! It made me lose trust in the medical system.

I feel for you and only hope that you can work through this with minimum problems. I also had the police sent to my house - to confiscate my keys. I've NEVER ever been in trouble or even had a parking ticket. And the dammed police hand cuffed me!!! I'm a 43 year old woman - very tame and I don't even drink.

So I guess all I can say is that I relate to what you are going through. It is legal what they do. And no one will listen to us over them. Sometimes they over-react - but just work through it with them. Play by their rules for a bit and you will be out of the system much quicker. Grin and bear! Good luck.

yeah. he can claim you were a harm to yourself or others...that is enough to send the police over. they can't take you if you seem to not be a threat to yourself or others.

so hopefully they didn't force you. cause there is a problem there

I work in a psychiatric unit and here in cincinnati that's called a 72 hour hold. If your therapist or psychiatrist or whatever thinks you are a threat to yourself or anyone else he can have you sent to the hospital to be evaluated and possibly held. Anyone can, really. Say you're at home with a family member and you say you want to kill yourself and you're going to do it, they can call the cops and have you picked up and held at the hospital under a court order. Yeah, it's pretty much legal.

sorry u had that experience, i thought i was going to have a similar one once i got a little too honest with my shrink and stuff...thats how it works though, just try to still be honest about how u feel and what u do. n yes i think it is legal

To have mental health care forced upon you, it all has to go before a judge. Of course you can still be locked up in a hospital for 3 days if someone says you are dangerous.

It's in the contract that he should have explained to you and you should have signed. And there should have been a contract before the therapy could have begun. There is confidentiality between you, but if you express in anyway that you will harm yourself, somebody else, that there is somebody that might being danger due to your actions they have to notify the right authorities.
