Can anyone help on a CPS issue??!


Question: My little sister is 17, and she's crazy. She is a manipulative, abusive liar. She has already gone to juvi a couple times for stealing and abusing my mom. She was expelled from school for selling prescription drugs to students which put her behind her fellow classmates, so to give her a chance my mom put her into an alternative accelerated high school which is far and out of the way from where they live. My sister has also been diagnosed as manic and bi-polar. Earlier today my mom took work off to take her to a behavorial health clinic where my sister told the counselors that my mom treats her like a dog and beats her and denies her the basic necesseties to live, which is completely NOT TRUE. i just moved out and i know that my sister is well taken care of, but due to her past confrontations with the law my mom has set strict rules for her which sets her into a frenzy. Now the counselors have told my mother that she is going to be investigated by CPS. What are my moms rights??

I am sure every state has different rules and laws pertaining to this. But, I would think that during the investigaton a caseworker would talk to your mom. I would have her show the worker the past evidence of the mental illness, legal problems, and abuse she endured from your sister. I would also have her ask that the caseworker speak with you as you are another one of her children. If your sister does have these mental illnesses, maybe your mother could ask CPS for help in finding her treatment options for your sister such as an inpatient program which also offers the alternative school that you mentioned in your question.

If your sister has these problems, they may see this in the interview with her. A "seasoned" caseworker may be able to tell if a child is embellishing a story somewhat.

Also, I would hope they would take into consideration the medical/mental health records that you supply. If you cannot give them to the worker, there should be releases you can sign so that they can talk to the doctors themselves about the treatment she has recieved so far and diagnosis that she may have.

I have no idea what her rights are but you need to remember that CPS is there to try to help. Since your sister isn't telling the truth Cps will figure that out. CPS can be an awesome tool to those in need. Maybe they can help your mother find some solutions to the stress your sisters mental illness is putting on your family. I have had a CPS case before because I had made some huge mistakes and was failing my children. I did not lose my children but was given many opportunities to turn my life around which I took full advantage of. These days no one would guess who I used to be. Tell your mom to be completely honest about her troubles and trust that they will help.
