I lost my job because I told him my boss I was in counselling.Is this fair?!


Question: I was offered some casual much needed work. I thought that I should let the boss know I couldnt work on a Monday afternoon, but could work the full rest of the week and any extra. I thought he was open and friendly enough and I knew him well enough to say I had a councelling appointment once a week so he knew it wasnt a negotiable appointment etc. He seemed real fine about it said no worries and he even said he would keep it to himself. Two weeks later the job I had been given was given to someone else. When I asked him about it he just shrugged his shoulders. No answer.

How could just saying one thing impact his thoughts of me so strongly? Before that I had heaps of hours of work and he thought I was great worker and we got on really well he was going to be taking me on permanantly as soon as a job came up I was even superviser when the other superviser was away/sick/ having time off.
Does this seem unfair to you?

This is unfair, and even illegal.
But proving you didn't get the job because of that is hard, and may stress you out more than gaining anything.
The lesson is : do not tell your employer your private life. My way to ask my employer time of for medical appointment/counselling is; "i need monday off due to other important private commitments".
If you're hard worker, a good employer won't want to loose you.
In your case, i hope your employer will realise his mistake

If you'd been there for less than 51 weeks you can be dismissed with out any reason. He didn't say that's why you lost your job and maybe it wasn't the reason

Yeah most definitely. You have a very strong case for unfair dismissal.

If your cash in hand.. No contract, then you cant do anything im afraid.

Depends how long u been working for him, And what your doing really

if u have a contract, u can take him to court, if ur cash in hand. you cant do anything as its jus manual labour.

It is more than unfair.You should go to citizens advice to
see if you can sue him for unfair dismissal.Good Luck

It was casual work he is not obligated to keep you in employment.

It does seem unfair, but can the person he's given the job to work every weekday? I don't think you could do anything legally, because you ex-boss could just state that you werent available to work enough hours.

When someone sets up a business it is to make them money not to supply you with a job.

completely and utterly - im so sorry this happened to you cus i know exactly how you feel - the EXACT same thing happened to me. try the citizens advice bureau, i know you probably just want to forget about it and move on but if you think you will regret not having your say about how badly treated you felt/feel, talk to CAB, or do some research into making a complaint. good luck...this world could really do without people like that.

If above is true, you were not a permanent, (full time), employee.

I doubt there's any recourse.

Yes it is very unfair and you should get unemployment easy. He can not discriminate against you because you seek councelling. The fact he could not give you an answer is because he discriminated against you.

yes very unfair but U will have to do any proving of ur case??? Counseling gets frowns but this should not happen!!! For all anyone knows You can be in counseling to learn to help & support an alcolholic brother or maybe you are going to donate a kidney So sum/1 backstabbed U.

it quite simply is gross discrimination .
your boss had no right to " fire " you .
you aproached him in confidence --- he should have had the decency to have honoured that commitment .
most companies have employee assistance help --- which covers a host of areas , and all in confidence .
see where you might sit with that ( i don't know where you live etc ) so i can't really give a wholehearted answer --- but you do have rights --- i'm just hoping you kept a diary .

what he has done is wrong..it is discrimination..take it to tribunal

it is unfair...the guvoner is just an ARRIS......go see the CAB and tell them the situation.....go for it and dont let the "B" get away wit it........good luck...

It seems really unfair to me but because he didnt give you an answer as to why I dont think you have any way to rectify the situation. I am told God closes one door to open another so I hope that happens for you and something better happens

Not only unfair, illegal. Check with an attorney.

See a lawyer as soon as you can. Do not let him/her get away with this. These kind of people make me sick and I truly believe what goes around comes around. They will get theres. Good luck and do not let this get to you. XX

yes this is unfair and you should go to the law centre and seek help you can get them for unfair dissmissal

That does not seem fair, but maybe the other person could work all the days he required and will not have to get cover. Employers do whats best for the company and money wise.

Unfortunately, thats the way a lot of the world is. They hear the word "therapy" and their opinion of you goes straight to the loonie bin. It most definitely is not fair, but alas seeking help for you mental health,though its becoming less taboo,will probably forever be "one of those things".Its as normal as seeing a physician, I just dont understand it sometimes.

Yes, it is unfair. Keep a detailed record of what occurs. If there is a Human Resources Manager, report this. If not, then report to your state department of work regulations (I don't know the proper name) . You can also google National Alliance for the Mentally Ill..They would certainly know where to refer you & how to proceed. You can also call a local legal advice hotline. I wish you luck & the courage to persevere in this search for justice..
