Temporary custody,restraining order?!


Question: if my wife is on Singulair which is being investigated by the FDA for Mood Swings,Depression and Suicide and she takes off with our 8 mth old son with 12 firearms 1000 miles across 7 State Lines but neither of us have filed divorce can I file a ex Parte restrainig order to get temp custody of my son to get her a psyche evaluation if I file first?She left 9 days ago but I just found out to what state and then the news said her medication is being evaluated for Mood Swings,Depression and Suicides

The first thing you should do is file for temporary custody. If you already have that she is crossing state lines as a non-custodial parent. The crime would be interstate transportation of a minor by a non-custodial parent. Please do what is best for the child. Also, contact the local Child Protective Services in that particular state. Even though this goes under law, i would call the highway patrol and have them pull her over, because in a sense thats kidnapping, and thats child endangerment, so i would say get the Psyche evaluation and get your child back

If you are not in a divorce I'm pretty sure you can't file for those things. It sounds like this has a lot of potential to just be a fight between the two of you and you are looking for revenge. Just because there are those side effects doesn't mean that your wife has them. If she does have them then you should be as concerned for the mother of your children as you are willing to file legal papers and take the children. My point is that there is just as much likelihood that she is the victim here as you being the victim so this is a hard question to answer. I don't think any law enforcement would let you do it for this reason. Their job is to make sure people are innocent until proven guilty. It is very hard to take children officially (even temporarily) from either side without having all your ducks already in a row, a lot of official investigation (child services, guardian ad litem), and glaring and specific proof of serious damage to the child.

Sounds like the right thing to do ASAP.
