Question: Is there anyway i can have my mom ordered to do a mental health evaluation or drugscreen!?
my mom has had guardianship of my kids for 5 years [{due to my past bad choices}I have been clean and sober for 3!.5 years on april 6 and i have a 3 year old that she tried to take away,UNSUCCESSFULLY!.In fact they {DCFS} said i was doing a great job and held the report as a false report at the state central register!.Next time she makes a false report its a felony!.She also made false reports of welfaare fraud and to the police!.She hit my child in the head with a vcr tape i witnessed this and told her to do counseling she moved with my daughters and it took me 4 months to find them!.She got a ppo which was dropped because it was a sorry attempt to keep me away from my girls!.now she says if i come around i go to jail!.!.!.dcfs says im a good mom but that i need an atty to terminate her guardianship!.sometimes on visits she seems like she is back on crack!. last time she stayed the night here she screamed out in her sleep all nite!.she seems mental!.and i know shes using with the $ for the kidsWww@Answer-Health@Com

look into a pro bono lawyer if you cant afford one - there are TONS of family advocacy programs which will aid in getting or keeping the birth family together!. Get on the phone and start calling around to find out what kind of options you have!. You would be surprised at how easily you can find what you need by calling different people and asking who they think you ought to talk to!.!.!.Www@Answer-Health@Com

You can't force her to go in for an eval!. Probably the state could if child protective services had reason to believe she had issues!. If she was mentally ill to the point where she was a danger to herself or others, a petition could be filed with the court and if a judge agreed, she could then be forced to go for an eval!.Www@Answer-Health@Com

Call child protective services!. Isn't that how she got custody of you children in the first place!? Keep calling until they do something!. Also keep a record of time and dates she has done something wrong!.

You need to call the police and file a report!. She hit your child with an object!. That's called battery!.Www@Answer-Health@Com

You could simply report the assault, with the VCR tape, that you witnessed to either welfare/child protection, or the police!.
They would be, definitely, obliged to take that seriously, even if it's been a few months since!. An assesment would have to be made, which would probably involve MH evaluation and drug screening
You could say, truthfully, that you didn't report it immediately as you had hoped things would improve, and didn't want to cause the trauma to the child, that would have ensued from an investigation!.
(Also if people appear to be on crack, they nearly always are, the night screaming is a classic symptom)!.
You wouldn't need an attorney regarding the initial report, but if you were the only witness it would be tricky, with all the allegations that seem to be flying around!.
In the UK you would be able to get an attorney equivalent for free through legal aid, to whom to present your concerns, and they to decide if the situation was actionable, but I don't know the system in the states!.
The crucial thing is that you remain clean, it's remarkable how that helps everything, without that you're lost for sure!.
