It depends on the severity of the alleged crimes and the possible sentences!. It also varies depending on where the crime took place (city, state etc) as different states have different standards for many if not most offenses!.

In some cases with good documentation and proof it can send a person to a locked mental facility instead of jail or prison!.

However in crimes such as murder and sex offenses; if one attempts to plead "not guilty by reason of insanity" the odds are not good!. In fact most of the time the person is found guilty!. A good example is Jeffrey Dahmer; there is no doubt that he murdered men and ate them, there is no doubt that he suffered from mental illness!. (I studied him in college) However his "not guilty by reason of insanity" plea did not work and he went to prison!. The latest statistics that I read was that 97% of those that plead "not guilty by reason of insanity" fail to meet the legal standard and lose!. The legal standard for insanity is the ability to know what one is doing is wrong and against the law!. (In the US anyway)

Here in Minnesota we had a judge that was charged with stealing money from a handicapped woman's trust fund that he was in charge of!. He tried to blame it on severe depression and had tons of proof, however he was still found guilty and sent to prison!. They wouldn't even let him try the boot camp that he wanted which would have given him a reduced sentence!. So in his case, having the depression didn't help his case at all!.

In conclusion, it depends on the crime, possible penalty and where the crime was committed!.

Assuming you have appropriate and sufficient evidence to prove you case, it's possible to be found not guilty by reason of insanity, temporary or otherwise!. However, this ruling generally still carries its own sentence of intense psychological testing and therapy!. It depends on what type of mental illness and what happened that you are now before a judge/jury!. It is also extremely difficult to prove beyond reasonable doubt and the vast majority of insanity pleas are thrown out!.

So is it a GOOD defense!? If you can prove it and are prepared for the possibility of being sentenced to an evaluation and treatment program, then you're welcome to try!. If you're simply trying to avoid getting in trouble for something, then I'd forget it!.Www@Answer-Health@Com

It depends on what you consider a good defense!. In a murder trial it will keep you from being put to death but you still get locked up!. In some ways it could be good!. In the above case if the doctors find after a number of years, your sane, then you may get out, but on the other hand in another case that you might have only been in jail a set time , let's say 5 years, but you have been found insane you may spend the rest of your life in a mental institution even if the original time of five years has past!. Is this a good defense to you!? Insanity must be proved, and if proved insane, a person lives in a world the rest of us will never understand!. Would anyone really want to be insane!? I don't think so, and if thats the case its a really terrible way to get out of trouble!.Www@Answer-Health@Com

Yes and no!. It may actually be a stay-out-of-jail/prison defense, however it will not set you free!. In most cases you will be committed to your States psychiatric hospital!. Most jails/prisons do not have facilities for the mentally ill who committed crimes, but were found "Not guilty" by reason of insanity!. Here comes the weird part, you will probably be forced to take psychotropic medications; after a predetermined length of time you will be reevaluated to see if the medications have made you sane and that you understand the consequences of your actions, if you do, you will then be deemed "sane" and can be tried for your actions that resulted in the criminal offense!.Www@Answer-Health@Com

That depends on what kind of mental illness doesn't it!? If someone says that they are too!.!.!. slow or braindead to have meant it, then nobody will believe them!. You can't be that slow if you come up with something like that!. If it is something else that says they can't control themselves, then medical proof is all you need and it probably would work!.Www@Answer-Health@Com

People have been changing laws because too many people have tried to use this in their favor in court!. If you do have proof that you are mentally ill, they will most likely put you in a "crazy" house instead of sending you to jail!. So, unless you wish to be with some psychos everyday, it's best if you don't use the "I'm mentally ill" card!.Www@Answer-Health@Com

As to the original question: if you're asking if you can get away by lying to a court by pleading false insanity, well, there's a name for that: "perjury"!. And it's illegal!.Www@Answer-Health@Com

No!. They don't let people get out of jail free for mental illness anymore!. Every prison in the country has special sections where they put you in if you are mentally ill!. The jail in my county has a 500 bed mental section!. That is way bigger than any of the mental hospitals in the area!.Www@Answer-Health@Com

yes it can in fact my father has Psychosis and a few other things and because of this he has had two mental evaluations and he will be sent to a hospital and not in jail!. my father had a 500,000 dollar bond and he will just be "free" after what he did!.!.!.pisses me off!!!Www@Answer-Health@Com

Because so many ppl used this as an excuse for what they have done the poor ppl who really have a mental illness are now going to jail and being forgotten about and not receiving the help that they truly need!.!.it's a sad world out there!.Www@Answer-Health@Com

I guess the word would be "Defense"!?
It's not a "Get out of jail credential", but helps the courts decide the better choice for a person's sentence and rehabilitation!.Www@Answer-Health@Com
