Can my psychiatrist legally tell my mom??!


Question: Can my psychiatrist legally tell my mom!?!?
I have been on 80 mg of prozac for about a yr and i have stopped taking it the past 3 weeks because of all of the weight gained!. I have already lost 15 of the 20 lbs gained :] and have had no off pill side effects!.!.!. but my OCD is BADD

i'm 16 yrs old!.!.!. i obv want to tell my psychiatrist when i see him!.!.!. but my mom would KILL me!.!. and my mom and him always talk!.
Isn't whatt you say in a doctor's office condidential unless they think that your life is in danger!?
I really want to start cognitive therapy and try maybe a different pill

btw!.!. i'm a really small preppy girl w!. friends!.!. so i think that they think that everything should be open for some reason!?

The government is what regulates situations like this!. It does it through this law called HIPAA!. I won't go into the details, but it basically says that all medical personnel from EMTs, nurses and doctors all the way to secretaries and insurance people MUST keep all their patient information private!. The minimum fine is like $25,000 for any violation of the law!.

HOWEVER! I am extremely sorry to tell you that this law doesn't to minors, which are people under 18!. Legally, your mom is your guardian and representative, so any of your medical information, can be discussed with your mom!.

I understand what you mean about the Prozac though!. It causes huge gains in weight!. But if you have a good psychiatrist, all you have to do is tell him, and he should understand and give you a different pill and start you on the therapy that YOU want!. Your mental health is something YOU know best, and things you WANT to try should help the best, instead of some pill that you don't want to take!. Make your psychiatrist understand this, and he will help you, and probably convince your mom to be in board with it too!.

Prozac!? For OCD!? I would think Celexa or Lexapro!.

Anyways, SHAME ON YOU! :) Never ever ever stop taking your med suddenly!. I've done it once or twice myself and I can tell you from personal experience it can be a bad thing!.

Michele is correct!. My son was in counseling for about a year and yes, he can tell your parents anything that is said because of the fact that you are a minor!. You should talk to him about it because if you were prescribed medication, then you obviously need it!. Maybe he could "suggest" a change to your Mom on your behalf!? It's worth a shot! You are 16 and not at risk of hurting yourself or others so it would be breaking patient confidentiality; but every state is different a little so you 'll have to look up what your state law is!. Best of luck!!Www@Answer-Health@Com

whatever you do with the psychiatrist while in session is protected under a patient/doctor law!. Kind of like when your underage and get prego the doc can't tell your parents!. If he does I would sue his *** if he did tell your momWww@Answer-Health@Com

It is the psychiatrist's obligation to breach patient confidentiality if the patient seems to present harm to him/herself or to others, this is called "duty to warn!."Www@Answer-Health@Com

Legally, yes - your medical record (as a minor) is the property of your parents!. Minors have very few (read: nearly none) confidentiality rights in a mental health context - this is a common misunderstanding among teens!.

Practically speaking, however, unless there is a very good reason to alert your mother, he probably won't!. Although he (your psychiatrist) would have the prerogative to share this with your mother, it may be to your therapeutic benefit not to share it!. It could, for example, be a jumping off place for you taking more control over your own treatment - and by extension - your own life!.
