California Disability?!


Question: California Disability!?
I was on disability a year ago from April '07 to April '08 due to a complicated pregnancy and then death of my newborn!. I went back to work for 3 weeks and then started having panic attacks!. My psychiatrist put me off of work with lots of medication to handle these attacks!. I put in a new claim that will be based on a different "base period"!. Does anyone have experience with 2 claims and getting awarded disability again for a different reason!? I haven't heard anything yet from EDD!. I would appreciate someone's info from experience with State disability!. Thanks!.Www@Answer-Health@Com

I am not an expert, but I can't think of any reason why you can't have 2 claims!. A lot of people go on and off of SDI throughout their lives!.

I think the question for you is whether there will be any earnings in your new base period!. If you put your claim in in July, the period is probably March to March, during which you might not have earned much!. If you got the claim in in June, the period would be Jan to Dec of '08 so the Jan to March earnings might provide for at least some benefits!.

There is usually no harm in appealing an adverse decision!. If you don't like the result, I suggest that you file an appeal and explain to the judge that your earnings are not representative because they were interrupted by a period of disability!. There may be some discretion to increase the benefit amount!.Www@Answer-Health@Com

I just had disability this year in California!. You can file 2 claims for the same disability if you need to! You can have a relapse!. In your case, if you can't work for a different medical conditon, it's just a matter of getting that new doctor's written approval and you should have not problem at all!.

The "base period" could be more time, or less time depending on the EDD policy!. You should hear from them no later than 6 weeks!.Www@Answer-Health@Com
