Mental Patient Rights in Ohio? ?!


Question: Mental Patient Rights in Ohio!? !?
Life's gotten pretty rough!. My husband has been very ill (stomach problems) for two months, and has lost his job!. Since I'm having a really hard time finding better work, we're struggling with our bills!.
This doesn't pair well with his chronic depression and history of suicidal tendencies!. He's been good for years, but has become suicidal again under these circumstance!.
I want to take him to the crisis center tonight, but he's unwilling to go!. He's been in a mental institution before and it was a very terrible experience for him!. Such that he says it will push him over the edge to be jailed like that again (looking in his eyes, I believe him)!.
I'd be more than happy to refuse his admittance to an institution if I felt another path of treatment would be sufficient, or to pull him out of a hospital that isn't treating him well enough or is doing more harm than good!.

However, I'm not sure what federal or Ohio law dictates!. I want to help him!. I very much need him to live!. But I don't want some quack on a high horse to lock him up in a padded room until they think he's better!. I know there would be no getting better from that!. If he didn't figure out a way to kill himself despite restraint (he's very clever) he'd never be the same anyway, and most likely never forgive me!.

So, what are the rights of a mental patient and spouse in Ohio!? Will they need my permission to send him off somewhere!? Can I check him out of a mental institution at will!?Www@Answer-Health@Com

I am a therapist in Pennsylvania, and the rights here are quite similar to the rights in Ohio, so you and your husband do have the authority!. If you decide to have him put on a psych hold, the only way they will take him without his consent is if you can convince them that he is a danger to himself or someone else!. That would be a 72 hour hold in a mental facility!. If you can get him to go willingly then he could leave whenever he wanted, unless he was telling them he was suicidal, that is when they would keep him longer!. So I actually think the best bet would be to get him into some treatment first, not putting him into a facility, because if he is as you say then he may try and kill himself, and then you will not e able to get him out when you want!. You should try and get him a good psychiatrist or therapist, and get a new evaluation done one him!. I know you say he was doing well for awhile but this new situation with the money problems is making him wirse, so you should get another psychiatric evaluation, and then when that is done, he could even be elgible for social security because of his mental disorder, and that would definatelyt help you guys out with money since he is not able to work!.
