Is my brother guilty of assault?!


Question: Is my brother guilty of assault?
My brother suffers from a serious mental illness (bipolar 2) and he is currently seeking psychiatric help.

The psychiatrist made a mistake and gave him medication for ADHD which caused him to go into his mania phase where he had a violent outburst. He says he couldn't control himself and the hole event is all fuzzy to him.

Basically someone touched his arm and he yelled "DON'T TOUCH ME" and then punched them in the face.

The police are pressing charges.

Is he going to be charged with assault?

Answers:

He shouldnt be for multiple reasons. First the doctors are at blame for giving him the wrong medication. They must hold all responsibility, and they can get in serious trouble for giving your brother the wrong type of medicine. Also, if the person did indeed "touch him" He can say he thought that person was trying to assualt him and merely protected himself. It is very easy to bend the law in your circumstance. I doubt he will get in any trouble. If indeed he does get in trouble, ask for it to go to court and ask for mediation. Through that proccess you wont have to pay money and your brother will most likely be innocent of all charges. Hope this helps!



Yes. He assulted someone. You know the shooter in Arizon who just killed 9 people? He was Schizophrenic..... maybe they should just let him go. They may go easier on him IF it is a first offense but Bipolar or not he still assulted someone....
