Question: If you overdose and refuse treatment, can the hospital staff restrain you?
If you overdose and are taken to the hospital, can you refuse treatment, and just walk out of the E.R.. Do we have the right to refuse treatment.. and what happens if you tell them you're refusing treatment and try to walk out.. can they really go after you, or do they let you walk out

Well, I overdosed once, you really aren't conscious and even if you are it is really hard to react to anything because you're so out of it , they wouldn't let you leave or refuse treatment, I had to stay for 2 days after they pumped my stomach X . X I'm not really sure what they would do if you walked out though.



they will restrain you and force treatment upon you. they even have the right to strap you down. If you have overdosed, though, you probably won't have the strength to walk out or object anyway.

You are not allowed to walk out of an ICU under any circumstances. When you overdose that is usually where you end up, ICU. They will usually ask you to stay longer once you have recovered in a rehab or mental health facility. They can also force you to go to the rehab/facility. If you refuse they will hold a hearing where you may defend yourself, but will most likely lose. If it comes to a hearing and you lose, they will have a required number of days that you must stay (usually 5-7). Since at this point it is court-ordered, no one, not even parents can get you out of it. If it doesn't come to a hearing and you accept treatment, you are allowed to check yourself out earlier.



You can be arrested and restrained on the spot. All in all refusing will make everything harder on you, and you will be more likely to be sent to a rehab center by court order in which you can't get out until they let you out. Not even your spouse, parents, or anyone else can get you out of rehab. If you have taken an overdose, get the treatment.



If you have overdosed you are considered to not be in a rational frame of mind and they can restrain you. They will hold you down, insert a tube through your nose, down your throat, and into your stomach to administer charcoal or pump your stomach..... then they tie you to the gurney with leather straps at your ankles, wrists and across your chest and hold you in the psych ward for 72 hours or longer. Been there done that.



Yes they can because if someone OD's on purpose they would be deemed to be of unsound mind and therefore unable to make rational decisions regarding their health.



I'm pretty sure you can't claim 'sound mind' after an OD, so they can probably restrain you, or force treatment on you.



That would amount to Attempted Suicide, which is illegal, so yes - they can force you.
