Can clinical depression be treated as a disibilaty?

In a previous question I mentioned I had been injured at workand was on comp. I was also rather depressed as a result of it. I got fired before my Doctor returned me to full duty. Can cclinical depression be used in the case against them since it was obvioulsy affecting me in a detrimental way?

Hmm. That's a tough question without an easy answer. I would say the answer to the first question (Can clinical depression be treated as a disability?) is "Yes." But the answer to your second question (Can "it [depression]" be used against them {job}?) is probably "No."

I'll tell you what my reasoning behind this is. Any medical condition which can cause you to be out of work for at least a year is elegible for SSI and that includes, but is not limited to, depression. The problem with that is that it can take a year anyway of applications, doctors appointments, and possible at least one if not two appeals. But can you use your depression in a case against the company you worked for? Absolutely, positively, NOT! By even considering going against a claim for the job that you previously worked tells others that you have a victim mentality. I don't know. Maybe you do have a victim mentality. But I tell you this. I doubt seriously that you'll recover from depression so long as you feel that you're a victim. You losing your job was probably a result of your depression affecting your work in which case your job was probably justified in firing you. That might be helpful in your disability case, but your job was not wrong in letting you go. I understand as I was in a similar situation playing piano at a four star hotel. And management was right to let me go. I have since recovered daily and there is no malice between me and my old job and management. I hope you feel better.
