The velum is another term for the soft palate. The uvula is a projection made of muscular tissue covered by mucus membrane. The velum is a term for the area proximal to the teeth.
BUT if these are questions off of a school assignment or textbook I would think that the phrasing of the second question infers that the author includes the uvula in the collective term velum. The uvula should "close" for the production of oral sounds. Technically the uvula doesn't "open or close" but rather the position of the muscle allows for air to be blocked from resonating into the nasal passages. In a small number of people, the uvula does not close properly against the back of the throat, causing a condition known as velopharyngeal insufficiency or VPI. This causes "nasal" (or more properly "hyper-nasal") speech, where a lot of extra air comes down the nose, and the speaker is unable to say certain consonants, for example producing the sound /b/ like /m/.

Yes, the velum includes the uvula as it's a part of the soft palate. The velum remains open for phonation as it needs to be bypassed for clear vocal sounds.
