Herpes simplex 1 is indicated by cold sores visible around and in the mouth. With regard to your qualifier of the partner having "no open wounds": It not a requirement. If the person has had a recent outbreak there is something called shedding where in which the virus without visible sores can be released.
So if someone has had a recent outbreak I would not engage physically in intercourse or kissing until a week to 10 days after there are no visible signs of the outbreak.
Oral herpes, yes. Genital, not likely unless oral sex was involved.
