Illigal not to disclose herpes if you know you have it ??!


Question: was with my ex for a year and a half...yes, I am naive..but he told me the redness was because of his psoriasis (he had on his legs)..he used a cream sometimes so I was ok with what he told me,seemed honest enough... then after we broke up,I was cleaning out my car and found an insert from a Valtrex Rx,wrapped up in a Rx for this cream he used...of course I freaked out..called him and he denies it,says its not his Rx..( riggghhht , and it came from who else ?? )...but hes dating this girl and i called her, he told her the same thing..isnt this illigal not to disclose if you have an STD ??? where can i get real proof , can I contact his doctor or health dept...i know about HIPPA, but shouldnt they be able to tell me...my testing is scheduled for next week...I have never had any symptoms......

if u haven't had any symptoms the u may not get accurate results from a blood test. depends on the laws of where u are located. if u can prove that he intentionally gave u herpes then that would be another thing. i think it also depends if the std is life threatening (which herpes is not it just incurable). there may be something u can do to get him to shell out some money for the meds if u do have herpes. its his responsibility and his right to tell whom ever he wants that he has herpes. people will lie about stds in order to get sex and not scare a person off. maybe talk to a lawyer and doctor to see if that is possible.

It's not illegal to keep an STD that isn't lethal, and only represents an inconvenience, from your sex partner. At worst, it's a misdemeanor.

However, you'd have fantastic grounds upon which to sue him, for the cost of, for example, your treatment (perhaps a few years' worth of Valtrex or other anti-herpes med, plus doctor's visits for the treatment and/or diagnosis). Maybe even more emotional damage, but that's a stretch.

It makes more sense to sue rather than hope the law gets him - that way you benefit.

Also, if you have never had any symptoms, there's a chance you don't have it, or are just a carrier. I once was in your situation, and had unprotected sex with a (now ex) girlfriend for almost half a year, who later turned out to have herpes. I have never had a breakout. I wanted to get tested for it, but my doctor said there was no test for herpes that didn't include taking a skin sample of the breakout. So until you have that first breakout, you'll never know if you have it. There's about a 70% chance of contracting it when your partner is having a breakout (and less even then if they're on meds), and a VERY low chance if they were not showing any herpes symptoms.

I'd wait until you see something... down there. I have yet to show any signs, even after years. I don't tell all the girls I'm going to sleep with (oh, there's a very small chance I might have herpes), and since I usually stay friends with most of them after, not a one has ever come to me and told me about her herpes, and most of them would if they developed it, because I'm cool with them like that - and some of these ex-girlfriend friends have been friends with me for years too.

Valtrex is used to treat:
Treating shingles
Treating cold sores
Treating genital herpes
Preventing recurrent genital herpes outbreaks
Decreasing the spread of herpes to sexual partners.

And as far as I know only comes in Caplets and Tablets.

If you can prove he knew he had it when you had sex or its his prescription you probably have a case.

YES IT IS VERY VERY ILLEGAL!!! TELL EVERYONE RIGHT AWAY BEFORE YOU GO TO JAIL!!!!!!!!!!!!!!!!!!!
