if you're not the friends' doctor or have any other sort of confidentiality agreement, then it's not illegal. but it's not very ethical. just hope that friend is responsible enough to disclose that at the right time.

If you are not the treating physician of the HIV patient...it is not illegal. You are not bound by confidentiality laws.
