How can i press charges on my husband for given me HIV?!


Question: 2006 i found medication in my husband draw. the medication was for HIV i asked him did he have HIV and he said no. I went and took the test and i came back positive i went to him and he told me he found out 2 weeks after i found out. and he didn't no how to tell me. so i foregave him and moved on. but i found a paper in his draw that have a date of 2004 he took the test in 2004 and he was positive. he never told me i was sleeping with this man every night thinking i was in love. he kept this information from for 2years still haven unpertected sex. he use to get up set with me when i was to tired to have sex. anyway when i found the paper i was hurt i left him alone now im so hurt that it seems like i can't do anything. he wrote me a letter to ask me for a divorce and he wants me to pay for it. i talked to a lawyer and she can't do anything because we can't get his records he took the papers i found and burned it now i don't have proof please some one help me. what can i do.

I know that is considered attempted murder because he knew and decided to infect you with the virus insteadof telling you also do you know how it was transmitted to him and if it was through sex and he tested hiv+ while you were with him you could push the issue of adultry also some states do blood test before giving you a marriage license if that is the case get a copy of that test so you will have it also if you know where he had his hiv test done at get a medical release form sign his name and mail it in to them Iam not saying that is right also if he is the one that ask you for the divorce let him spend his money and if you go to court get your atty to ask him about the hiv if he lies that is contempt of court the truth will come out in the end also ther is proof somewhere don't giuve up if you want something go for it try to do it as legal as possible don't go to prison I know the state where I live at you can sign your husbands name and that is legal here b

I'm not sure. Maybe call your local prosecutor they would probably be the ones to bring charges. I think they could probably get his records. I hope you are getting the help you need though.

I would for sure go to the police, because that is considered attempted murder. This guy is a horrible person and you need to get him put away so that he doesn't do this to some other innocent person. Try going to the prosecuting attorney they can require that he take a HIV test. If they can't help you then they should know someone that will help you. There may be laws in your state against people who knowingly give others HIV ... KNOWINGLY... check your state laws and consult a pro-bono lawyer.

Yes you can press charges but what kind you can press depends on where you are. If a criminal case is not possible definitely a civil is or ven both. Talk with a very good lawayer. It has been done before. Also dont worry about evidences, a good lawyer can always demand for the records especially in a existing case. Good luck and God bless

Some states require that if you are HIV positive that those records are kept in some public office or something of the sort.... Call your local DHS office and get your states ruling on STD's and the law this will tell you where to go from there.....

Actually, I think that you CAN press charges and you certainly don't have to be the one paying for the divorce if he is the one initially seeking it. The records from 2004 should be easily traced if they are to be used in court. Your county health department should have them on record and therefore be able to disclose the information to your lawyer. I would try calling different lawyers until you find one who gives you the help you need. Good luck! :)

Talk to a attorney ... call legal aid in your area. There has to be something that can help you. You are already paying for it with your health!! that rotten bastard. I am so angry.... this is so awful.

How did you get married without blood test. Or did you not do this. I don't really understand. But a good lawyer can get you everything you want.
