Is it legal to knowingly spread an incurable STD?!


Question: Is it legal to knowingly spread an incurable STD!?
My 20 year old sister has genital herpes!. She is not on any kind of surpression medication!. She is having sex with multiple men!. And when I say multiple, I mean there are at least 15 that I know of in the last 6 weeks or so!.

I asked her if she told the men she had herpes and she replied "No this is a small town and I don't want it to get out"

She claims she is using condoms everytime!. However I do not believe her!. She lies about 90% of the time!. At first I didn't even believe that she was sleeping around as much as she says but I have since heard from other people that she is!.

Even if she is telling the truth condoms aren't 100% effective and I think that who ever she sleeps with has the right to know that they may be putting their health at risk!.

This is a small town and she is sleeping with men in her age group (early 20's), I am sure these men will go on to have other sex partners, girlfriend, someday wives!. She could literally cause an epidemic in this town!.

I have put a call in to the local public health nurse, and am awaiting her reply!. But I am wondering if there is anything that can really be done about this!?!?Www@Answer-Health@Com

Unless she is holding a gun to their head it is 100% legal!. Hello, they are being negligent in having sex with her (condoms or not) without knowing for sure her health status!. So they forfeit their right to sue!. Well they can sue of course but they haven't got a chance in hell of winning!. (Unless it is a celebrity with $$$$ who will settle out of court- that has happened!.) Herpes is not deadly there is not a damn thing they can do!. They should be glad it isn't Hep C or AIDS and quit screwing women they don't know! Most people don't even know they have herpes, 1 in 4 have it so anytime you sleep with someone there is a 25% chance they have herpes!. IT TAKES TWO TO TANGO!. Everyone needs to know there are revengful people out there and demand mutual testing BEFORE sex!!!!! People need to take responsibility for their actions!!!Www@Answer-Health@Com

This is so common!. Think about it, she got the herpes from being careless and continues spreading the love around!. I know it is illegal to have unprotected sex with someone if you know you are HIV positive or have AIDS!. Of course this is a life sentence not just sores!. this is exactly why people who have unprotected sex get exactly what they deserve, your sister included, she got it from someone too!.
And no, there is no legal recourse, because sex between consenting adults is legal, and adults accept the risks and responsibility for doing so!.Www@Answer-Health@Com

I know that it is illegal to have sex with someone if you have HIV and do not tell the other person before having sex with them, but I do not know about any similar laws regarding herpes!.Www@Answer-Health@Com

not to mention the condom is only going to protect the penis, a lot of times the warts are on the pubic area and skin to skin contact of the pubic area will spread the virus and infect the person!. I know some states knowingly transmitting STD's to other people can be considered a crime and the person can be prosecuted in court!. You should defnitely let the department of health know about her, not only is she infecting all these men but then all the women these men turn around and sleep with!.Www@Answer-Health@Com

And besides - you do not have to be on suppressive therapy to know your symptoms and keep others safe!. I've never used suppressive therapy!.

Herpes, while incurable, is not that big a deal, physically speaking!. It doesn't lead to other diseases!. It's not fatal!. It doesnt' cause infertility!. In fact, in most people the symptoms are so mild that they don't know that they have it!. It's just like oral herpes (which 50% to 80% of adults have) except that you get sores on your genitals instead of in your mouth!.

Should she be sleeping around without telling these men!? No!.
Is it illegal!? Probably not!.

They have to assume some responsibility, too!. Condoms don't protect against herpes or HPV, and if they don't ask for her test results before they sleep with her, then they are taking on some risk themselves!.

While what she is doing is foolish, and unkind, I don't believe it is illegal!. And, to be quite frank, I'm not sure that it is your place to speak to other people about this!. (In fact, I'm not sure whether you can legally disclose this kind of information to other people - certainly not in any official capacity!.)

Wow, thats just wrong!. On so many levels!. Your sister needs to go see a doctor about her herpes!. It is in fact illegal to knowingly spread a incurable disease!. In Canada there is a man being tried on first-degree murder charges for having unprotected sex with women without telling them that he was HIV positive!. Several of the women contracted aids and so far 2 have died!.

What your sister is doing is obviously not as extreme, at least no one will die of genital Herpes as far as I know!.!.!. but she is still leaving herself wide-open to a serious civil lawsuit, if not an outright criminal indictment!.

And btw if she's afraid of the word getting out if she tells someone, what does she think would happen if one of her partners contracted her Herpes !? Www@Answer-Health@Com
