Question: Please help legal experts only?
Is it possible to report someone who you SUSPECT may have HIV? I dated this guy for 2 years but never had any type of sex with him because he always refused an HIV test. Because of this and because of his symptoms that he would complain about, I am suspicious of him. Can I report him on these grounds?

Report what, exactly? He hasn't done anything illegal, at least not that you've mentioned.

Edit: I'm not "dumb"-- you just didn't provide all the information. I suggest you call your local health department and ask if you're concerned.



There is absolutely nothing you can legally do to him. The government cannot (and should not) police people who are infected with HIV. If he knowingly and willfully gives someone HIV without first informing that person he is HIV positive and obtaining their consent, that person can prosecute him in criminal and civil court. The legal system cannot prosecute people for crimes they did not commit or attempt to commit. Given that you don't even really know his HIV status, there is nothing you can really report.

If you really, truly believed he was HIV positive and was lying to you, why would you date him for two years? There are lots of reasons people refuse to get tested. Maybe he's afraid of needles. Who knows? Sounds to me like you are bitter and getting over a bad relationship. My advice is let it go, find a new boyfriend and move on with your life.

reporting him seems like a selfish thing to do when you don't know the facts, so he may have HIV whats to report? he hasn't done anything wrong, hes not forcing you into bed, and for 2 years not having sex because he wont have the test, surly you should respect him more than to report him
