Dental Malpractice?!

Dental Malpractice?

How should I offer to settle out of court with a Dentist (s) practice? I did a stupid thing. I wanted braces like the gangster rappers and I paid for them. Like 800.00 cash. They were put on by a Dental Assistant/after hours/no records/no followups. Dear God, I want them off. I'm getting headaches every day. My gum is dissapearing on the bottom. The brackets are gone and some are loose. The practice is well known and pride themselves on their work. I also fear retaliation from this girl, the assistant. Maybe there is a need for an investigation now, since braces are a trend. She may be soliciting her own services using company name. Please keep in mind that I did not need braces...my teeth were straight.I did this a year ago...Do I settle out of court. Should this be reported? To Who?

WOW! First of all, why on earth did you let an assistant put them on?? I am a dental hygienist and am horrified that an assistant would agree to do this. She could be in HUGE trouble. I may be mistaken but I don't think the practice could be held liable b/c there were no records. In dentistry, if it is not documented, it did not happen. You have no proof it happened in this office. Your biggest concern right now needs to be getting those things off before they do SERIOUS damage to your gums and teeth. I would contact the board of dentistry in your state to report her, but I am not sure what will happen b/c you knew she was only an assistant and you went in after hours willingly. Good luck!
