Question:

I would like to know if you can sue a dentist.?

My 15 yr old son has an impacted tooth which has turned sideways. We were sent to an orthodontist to have it fixed and to have braces put on his teeth. Well this orthodontist would not do it because they said that his state medicaid would not do it because he did not meet certain criteria. So long story short, we went to another orthodontist who said he could do it. That was 3 years ago he finally has braces (after wearing retainers for a year.) and the doctor finally addressed the tooth issue, its too late. The impacted tooth has caused one of his adult teeth to grow at an angle and now my son has to have surgery to have the braces that are on there now removed the impacted tooth removed and his gums cut open so they can attach a chain to the tooth that is not coming in correctly. I had to go to another orthodontist to find out this because my doctor wanted to just remove the impacted tooth and hope the other one would come in on its own.

As far as the first dentist, I dont hold him responsible. As a matter of fact we are seeing him now. It was a long complicated matter, where my insurance said they would pay for it but the person who files the claims at the dentist office did not bother to because "she" felt it wouldnt meet medicaids criteria. I called the insurance company myself and they said they would definitely pay for it but I should probably find another orthodontist. So I found the next one who was hired just to fix the impacted tooth because my dentist recommended braces so he could attach them to the tooth to pull it down. I went to the other orthodontist and he never addressed the tooth, when I would ask he would say we have time blah blah blah... Now because he waited so long the tooth has turned sideways and its a more involved procedure then it was before.


Answers:

3 years is too long of a wait, plus his license wouldn't let him then thats that.
