What is the procedure to take a orthodontist to small claims court. will I need to hire a lawyer? Will the?

lawyer charge me or get a percentage of the winnings if i win. My orthodontist said my invisilign treatment was to be 15 months when I initially signed. Because I complained about 1 of his dentist that worked on me( she was kept cutting into my jaw when she shaved some tooth down everytime) now the orthodontist is saying that my treatment will be complete in a 4 month frame instead. I am on my 7th aligner and usually I come in every 2 weeks for a new set of aligners. This time he made a bump in my 7th aligner and told me to wear it for 1 month at which point my treatment should be over and completed. What should I do? I feel like he robbed me $6000 for 4 month instead of 15 month treatment plan. Can I get a refund? How do I get the original contract and what if he alters it? What kind of lawyer do I get?


Answers:

Remember that Invisalign is charged by case, not by how long it took. Unless the practititoner caused an injury to you and didn't tell you about it, you don't have much ground to sue.

Your orthodontist probably had you sign the Informed Consent form from Invisalign before you started the case. You might want to ask him to give you a copy of that, plus a copy of your records and x-rays. Have another dentist look at the course of treatment and see if the orthodontist did something questionable and did not tell you about it. If you were injured or if you were not told of complications that developed, then you might have grounds for a complaint. Timeframe itself is not grounds to sue in the eyes of most State Dental Boards.
