Should i sue my dentist, 3 years later?!

Question:

Should i sue my dentist, 3 years later?

So i'm not all hip to legal stuff. But heres the story.
November of 2005 i went into the dentist to get my chipped tooth capped...it was one of my two fronts (top).

I told them it didn't look good and the color was way too bright and they told me (not in writing) that the bright color would fade and it would grow to fit perfectly. Well, it's really done the opposite. Its gotten whiter .. i know my teeth arent getting yellow because i brush daily and do not smoke. It hurts when i breathe in cold air, bad!
Also, the tooth is too big in the back .. it just doesnt fit right anymore. It hurts, it gives me a headache, i CANNOT drink anything REALLY cold anymore .. when i drink a really cold can of pop/juice i have to press my lip up under my teeth so the liquid doesnt touch my teeth. I hate it .. when i talk you can see that its a cap.

He wouldnt listen to anything i had to say. He was foreigne .. just kept saying "its okay, its okay".

My mom was having work done their too and she also had problems.

I know a lot of poeple who have had problems with this dentist. I had a medicare card .. it's a cheaper dentist for people who cannot afford $1,000's.

Should i sue .. should i see a different dentist and get their opinion?

Advice please .. REAL advice ONLY! Thanx bunches

IF sueing him isnt the answer .. how should i go about getting this fixed? Anyone know ABOUT how much that would cost?

Answers:

as sad as it may be, winning a mal-practice suit is REALLY REALLY hard! ive had A LOT of dental work done, and some was not so great. so i can relate. i would go back to that dr and demand to have it fixed, free of charge. if he refuses, or does not complete satisfactory work, contact a lawyer. Lawyers only make money if you win a case, so they wouldnt lie to you if you didnt have a case. Just because there was nothing in writing doesnt mean that anyone who isnt blind cant tell work that isnt good! better yet, i would contact that lawyer (or several) first. finding a new dentist can be scary, especially if youve had a bad experience. if it were me, i would use that as a last resort.
