If you can prove that he didn't get all of the decay out then yes!. That's what they have malpractice insurance for!. The problem is that even with the best dental work in the world there is the possibility of a cracked or leaking filling!. It would be extremely difficult to prove!. There are a lot of things that can cause that problem, and a lot of things that the dentist can blame them on that make sense and happen frequently!. Sometimes the cavity was too deep the first time and the tooth just failed, sometimes you'll bite something just right and damage the filling, and sometimes the dentist completely sucks! I work for a dentist and I've seen a number of patients where the previous dentist did such terrible work that things abscessed and ended up hospitalizing the patient a couple of times!. They couldn't prove that the previous dentist did anything wrong even though it was so blatantly apparent!. Either way, if you have to pay for it out of pocket or not, don't go to the same dentist!. If you even think that they damaged your tooth like that then it's not worth the risk again!. Also keep in mind that the root canal costs $1400 but most of them need a crown and it's about the same price range!.
Good luck!.
Sorry about your terrible experience!.
Hope you can find a way to get it taken care of!.Www@Answer-Health@Com
