Question: Should I involve my lawyer in this dental office dilemma?
In early december I decided to have all four of my wisdom tooth pulled. So on Dec 7th I made an appointment with oral surgeon to have them to do xray on my mouth. It cost 100.00 dollars for just the xray and wanted to payment up front before billing my insurance. Anyway I scheduled myoperation for dec 20th. The total of the bill was 1860, they decided to added the xrays in so I can pay the whole bill on the day of the surgery. My mother payed 1100.00 and I paid the rest at the day of the surgery. She paid with her care credit card and I paid in cash.

The office told me they would bill my insurance and would send me the reimbursement check the insurance sent them. Now on Jan 17th I received confirmation in the mail from my dental insurance that a check in the amount of 97.00 was issued to the dental office on the 7th of January. However, I still have not received the check. Now on the 25th of January I received another confimation from my dental insurance that a check was issued to the dental in the amount of
1103.00. So I called the dental office regarding my checks. I spoke with the reception and she said the check had just arrived on the 25th of January and it would be sent out to my address.

I confirmed my new address with her and in fact I when I filled out the patient registration form I had put down my new address. She said the check should within 5-10 days. So saturday(the 5th of Saturday) comes around no check. I called the office and I spoke with the accound manager. Let me first say she had the MOST condscending attitude when I spoke with her. She told me the check hadn't even been sent out and that the dentists hadn't even signed the check. I told her to leave the check at the office and I will pick it up Monday. Her response was no call me before you come.

So I called her today asking her about picking my check and her response was "oh I already sent it out on the 31st," to your old address. I then asked her why did she say mail it when I specifically told her not to and that she said the check was the originally. Her response was that well you already received your check for 97.00, which I did not. She then said it's out of her hands now and there's nothing she can do and I'll just have to wait. Then she abruptly hung up on me. So I had mother call her to get the story straight with her. My mother said she was very rude and tried to out talk my mom, but she is no match for my mother. My mom then told her if my daughter does not receive a check by this coming thursday we would seek legal action.

In fact I'm filing claim with the BBB against this dental office and contacting the american dental associations to report them . I don't want to accuse this woman of stealing money from her job, but it sure does seem like it.

Mind you I have went to dental offices before that required full payment up front and would send patients their reimbursement checks in a timely manner.

Wow what a pain, I would ring the insurance company, speak to some in charge, ask them to send you a copy of the correspondence / and cheque details that were sent to the dentists rooms, (tell them it is urgent)
Once you have this ring the dentist, ask for him/she to return your call ASAP tell the staff it is regarding the billing matter, if they do not return your call, type a letter with a copy of the insurance cheque details and send to the surgery, tell the dentist that they have 48 hours to resolve this or you will be pursuing the matter legally.Good luck.

Hopefully the fact that your mother told them you would be seeking legal action if you do not receive your money by Thursday. If that day comes and you still haven't gotten it I would get a lawyer.



This is criminal conduct. The state's attorney in your city or county will look at it and may prosecute the dentist involved. He seems so crooked he could sleep on a corkscrew.

Yes definitely should contact a lawyer, sounds like the office is pocketing money that they shouldn't be.



this happens a lot when the Dentist is out of network. because the Dentist is not participating with your insurance plan the insurance usually reimburses the patient. (this is what the dentist would expect) In some rare cases they would send the payment to the dds even if he is not participating.
I would contact the Insurance explain your situation. they will likely tell you the dentist will need to call them to verify the check should have gone to you, so contact the dental office to let them know you are involving the insurance, once this is done the insurance can probably void the chk that is "lost" and have it reissued to you directly.
Save the lawyers fees and the further headaches and contact the insurance. it may save you alot of time too. and for future refference go with a dentist thats in network this would avoid you having to pay out of pocket. I hope this helps
