Drug screening rights??!


Question: Question Details: I posted about this, but its getting worse. My results will be faxed with my name, SS# and with results...I am using a prescribed drug I don't want anyone to know about..The person testing me will be my co-worker..as we are a clinic that does drug testing..Now the Boss lady wants us to undergo testing. Everyone there looks at the faxes & I believe that is an invasion of my privacy! Yesterday I found out that she is only testing 1/2 the company..which is discrimination to me. Heres my legal questions: Isn't my results private? and isn't that discrimination if you only test 1/2 of a Company?
Is there anyone out there who knows the law?

your right your results are private, they have no right to share them with the co-workers even if the co workers are the ones doing the testing, you company should of been more professional and hire another company to do these tests. I'm sure your company has a very strict confidentiality code, so why wouldn't this code apply to the actual employees as well.

well first off its called HIPPA laws and she can not let anyone see your information including your SSN.
but she does have the right to drug test anyone and any time - or she can termanate you. As long as the drugs on your test are prescribed to you she can not fire you.

But the results must be kept private
but that is not discrimination at all.

(You should have had to sign a paper when you got hirred that agreed to this....?)

If the drugs are prescribed then I do not think the tests will be looking for them?

They are looking for illegal drug use- cannabis, cocaine, heroin, amphetamines

Surely a prescribed drug won't show up against this test?

In the Uk they can only test if it is in your Contract of Employment. If it isn't and you refuse and then they sack you it would be regarded as constructive dismissal.

They are obliged to keep the results confidential and faxing results is inappropriate and you can insist on sealed letter.
Random testing is legit and cannot be viewed as discrimination.
