Before taking any action, I would contact your local housing department to find out your jurisdiction's laws with regards to rental properties.

Also, understand that there are thousands of species of fungi (mold). The black mold poisoning to which you are referring is Stachybotrys, which may produce mycotoxins that have the potential to become airborne. However, not all black mold is "THE" black mold. The only way to link this particular mold growth to your symptoms is to consult with a mold inspector who would sample the discoloration and submit it to a laboratory for analysis along with air samples to determine if you have elevated mold conditions affecting your home's indoor air environment.

If you or other members in your home are experiencing any of the symptoms that you listed, I strongly recommend that you see your physician immediately. These symptoms can be attributed to not only mold exposure, but many different health-related issues, some of which can be quite serious.

In the meantime, no matter what kind of mold is present, it needs to be removed. More importantly, the underlying cause of the mold growth needs to be corrected (ie. leaks, inadequate ventilation, excess humidity, etc.) to prevent a future occurrence.

Call the health department. They will be able to help you. You can look them up under your county office listings.

By law they have to let you out of your lease it they aren't doing anything about it. Request a mold currator in writing. You deduct repair and medical expenses from your rent, but be sure to tell the landlord why and document it in writing.
