Would it be possible for someone in the ER to validate your statement? You could ask the attending or the nurse or the admitting clerk - someone - to fax the pharmacy saying like, " Blah, blah, blah, prescribed for Jane Doe on 00/00/00 is not needed for this patient."

It may turn out to be futile to try to recover your cost for this medication. But if the doctor or the pharmacist or the nurse or whoever had to pay for it when it was wrongly prescribed, they might change their tune. Health care and meds are expensive enough as it is.

You can talk to the pharmacy that filled the prescription for you but it is doubtful that they will take it back.

I know some health law, and you can't do anything here. Sorry for your problems.

Only if every single pill is still in the bottle.

Bring it back and talk to the pharmacist.
