Question: I failed a random drug test at Walgreens, what now?
I work as a clerk at Walgreens and about a week ago, my shift was randomly drug tested. I just got a call from the lab today saying I tested positive for marijuana. They said they are going to call my employer to notify them. What do I do now? Is there any way for me to quit my job when my manager calls me instead of being fired?

I understand that drugs < jobs. I get it. I f*cked up.

Well, there's some good news. Firstly, the test is a medical procedure, which means that neither your employer nor the lab personnel can share the results with anyone else. They may (and will) choose to act on those results, but the information will not follow you to another job. If, by some chance, your employer or the lab personnel share the results with anyone else, it violates doctor-patient privacy, and you have grounds for an actionable lawsuit that you could retire from.

Second, alcohol and drug problems are considered a disability under the Americans with Disabilities Act. This means you have certain legal protections, although that may not prevent you from getting fired. Generally, an employer will send you to substance abuse counseling, and if future drug screens come back negative, you will be able to keep your job. This isn't always the case, though, as company policies usually contain some language stating that you must tell your employer about your "problem" voluntarily, and they will then arrange the counseling. Failing a drug test may be sufficient to get you fired, but employers will generally volunteer counseling instead, as it looks good for them to get employees off of drugs, and generally counseling is less expensive and less of a hassle than terminating an employee and hiring and training another. This could work as a get-out-of-jail free card for you, but it's a one-time deal. If you're not fired for this occurrence, you most certainly will be if you fail another test.

Your best shot is to contact your employer, preferably before the lab sends in the results. Either way, a little initiative on your part will go a long way here. Employers are smart enough to know that recreational marijuana use isn't going to cause you to rob the store or have a meltdown during a shift. They're probably not too eager to terminate an otherwise competent employee. Tell your manager what's up and find out what your options are.

Edit: As usual, there are a lot of unhelpful answers and ignorant posters chiming in on your issue. Failing a drug test IS NOT public information, though your employer may not be informed enough to know that. Regardless, when you talk to your manager, make it an "I'm sorry" talk, not an "I'm standing up for my rights" type of thing. You're fine, and this isn't the end of the world. Drug tests are administered to protect the company and to reduce liabilities, not to ruin the lives of former employees.

you can test positive for the weed if if you have only been with somebody who was smoking . admit nothing and if they fire you go for unfair dismissal

either way it won't matter. quit or fired....once u fail a drug test you are non re hireable at almost any retail store in the country...that information is shared for anyone who needs to see it...
