Being high on weed and talking about weed (or singing about it) isn't illegal. Not even being high on weed while driving a motor vehicle is illegal (as long as your not intoxicated). Only possessing/growing it is illegal in the United States unless your licensed to do that.
Whoever said it's not illegal to BE high is wrong. It IS illegal to be high, as well as to be in possession of marijuana.
However, once something is in the past, there is nothing the police can do. (Excluding things like robbery & murder obviously - we're talking about personally taking drugs)
Your or I can both go up to a police officer and proceed to tell them "Last week, I did heroine. And last month, I did magic mushrooms" - & they can't do a damned thing :)
Now, if you're high or on heroine at the time that you go up to an officer & say "I'm on heroine!".. you will get in trouble !
because you can't get arrested for saying you do something, you can only get arrested if you're caught with the drug on you.
because smoking weed isnt illegal, posession is illegal
