1. If the doctor has warranted that the surgery will produce a particular result, which of the following is most likely true?
A. There's an implied contract with the patient
B. There's an express contract with the patient
C. The surgery is cosmetic
D. The surgery is medically necessary
(I think it is either C or D..please help!)

I'm a paralegal with several years of healthcare experience -- I love contract law (which is what this is).
If a doctor directly tells a patient that a surgery WILL create a particular result, the it's an expressed contract with the patient IF all of the elements of a contract are met.
