Question: I took a fall down 16 steps at work, my back and legs are in terriable pain, I cant sleep in my bed, hurts to walk ECT. Doc put me out for 1 month, I see him again Monday, I know i cant return to work in the shape Im in. What if he releases me to go back and Im no better? What do I do ?

First wait until you find out if the doctor is going to release you. No use worrying until you find out. He can't force you to work when you're still disabled. Usually the work men's comp doctor will ask your Human Resource dept or your boss if they have any light duty that you can perform that won't cause you pain. If they say no, then the doctor should not release you. If he insists on releasing you, contact your company's work men's comp insurance company. If they won't help you, report it to your State Worker's Compensation Board. They will help you with this. Unfortunately, your boss may try to fire you if you don't return to work if the doctor does insist on releasing you and you can't return to work. They should not fire you as long as you are still disabled. Anything is possible. Report it to the State Worker's Compensation Board if you are terminated and accuse them of wrongful termination.

If your doctor signs a med cert saying you are capable for work (even on restricted duties) there is nothing you can do - besides trying to tell your doctor otherwise.

You must go back to work. Your employer will not cover you without a medical Certificate.
