Can i claim workers comp on a job that i hurt myself 3 years ago?!


Question: Yes & No! I got hurt on the job and it took month's to find that I had a ruptured disk in my back. And when they said I had to be operated on, I asked the Office Manager that I needed to file a claim. The office never reporeted it, had no recored of it, supervisor never reporeted it, so it was as if it never happened! The only thing I had to save me from totally being denied was the Doctor visits' date book. I had to get a Lawyer, and i'm disabled, but can walk a little, and pain still exist. So, if you went to the Doctor for the matter at hand, you got it!! But there is a lot of red tape to go through. Good luck, and I hope your situation is not as serious as mine!!

That all depends on whether or not you filled out the necessary paperwork upon date of injury at work. There is an incident report that needs to be filed with Workman's Compensation. If you reported it to your supervisor and he/she filed the report, then you can make the claim...I believe you have 8 years, but I'm not completely sure of the time frame.

No, you have a short period of time that you have to make the injury know to your place of employment. Documentation of the injury must take place soon after the incident. This will allow one to make an easier claim if a persistent condition were to arise at a later time.
