Question: I have a cousin who was told 14 years ago he had 10 years to live due to hepatitis. Now he also has scirosis. Just recently he's gotten worse. His legs are swollen and he's bleeding from everywhere. He wants to go to the hospital, but he doesn't want them to keep him there. I called and asked a nurse and she hung up on me. Oh and We are in Texas.

A patient can always refuse care and leave a hospital AMA (Against Medical Advice). However, insurance may decline to pay for the stay if the patient leaves AMA.

The exception to this would be if a patient is a danger to himself or others, in which case, a mental health hold could be initiated. Obviously, this applies to mental health issues, generally not physical issues.

By his symptoms, you should be calling an ambulance. Generally, you'll be seen faster if you come in via ambulance over just walking in. And from what you're describing, he sounds severely ill enough to warrant an ambulance.

If he's really bleeding from everywhere, his concern is not how long he's gonna be in the hospital. He needs to get there now.

generally, when the patient has the ability to make informed decisions and is of sound mind the hospital has no right to hold you against your will even if it is in your best interest. assuming he is legally an adult he can probably decide when to go or not. in simple terms unless the patient is mentally impaired they have the right to make stupid, even life threatening decisions by leaving against a physcian's advice.

from what you describe(unncontrolled bleeding and leg edema) he would be either very foolish or more concerned with doing things his way(binge drinking?) than trying to maintain his health.

He can be kept if a doctor thinks he'll die if he refuses medical attention and the hospital can convince a judge to sign an order. It happens about as often as people are hit by falling satellites. (I can only remember one such case, but it *can* happen.)

if hes taken to the er,and they find something where he needs to be admitted and treated yes the doctors would want you to stay ,but in his condition which sounds critical to me,i would think he truly needs to stay there but if he wants to leave hes taking a chance.

If he is underage it is up to the parents. If you are legal age or older the only way they can keep you is if you are under a psych hold.
