Worker Compensation Refusing to help me..?!


Question: Worker Compensation Refusing to help me!.!.!?
My manager at work at me do a task that I told him multiple times that I would not be able to do!.
This object is about 15ft high, I am 5'!. He wanted me to scrub a years worth of muck and dust and buildup off of this using Lemon Quat and very cheap paper towels!.
I grabbed one of our step ladders to try and complete the task as best as possible!. The Manager literally Nagged me to complete it right that second "Have you done that yet, go do it, do it " He told me to exceed my limits to get it done!.
While stretching as best as I could the step ladder slipped out from under me, causing me to land completely on my ankle then fall back onto the refrigerator!.
My ankle was seriously injured!.

I was out of work for about two weeks, but workers compensation will not pay for the second week at all because I had received note from doctors that I could return to work with restrictions!. Just like the first week he said it was illegal to say I couldn't return to work when workers comp was involved!.Www@Answer-Health@Com

First of all I know you are NOT going to like what I have to say, but-you just dont understand how workmens comp works!. and NO you case is NOT closed!.!.!.!.YET!.!.!.

THEY CANNOT MAKE A CLAIM OPEN AND SHUT SO FAST

1!.Anytime someone gets injured at work, You need to be off work for a consecutive 6 days - before the payment starts!., then they take the 7th day and so on!.
!.!.You do not get paid the 6 days before that and you only get 66 2/3 % of your wages!.

So why did the Dr release you - or did he just say you can go back if you want!? What restrictions!?
I think if I were you, I would return the Dr, you cannot just get a secont opinion and expect comp to pay for it - after you have gone to one dr, you must tell the claims examiner that you are having problems to go to a specialist!.

What workmen's comp never tells you is your rights or explain what is going on!. JUST because he said you can return, Did he actually release you and have you been there yet- if you are having alot of trouble, DO NOT GO BACK TO WORK, call and say your ankle is not OK and you are returning to the dr!. and payments will continue!.

If they give you any kind of hassle - GET A LAWYER!. WC is responsible for that injury for the rest of your LIFE - even 5 yrs down the line - if you need surgery- they must pay!. but it must pertain to original injury

IF you were 'seriously injured" you sure heal fast--


Depending on job, there really is no such thing as 'return to work with restrictions, it means accomodations-- and if they did not accomodate you right away,If you do go back to work, and cannot handle it, then payment process starts all over

Comp is responsible to pay you!.but truthfully if you havent been back, you are better off staying home!'

Look, I dont know what state you are in, but most of this is pretty cut and dry state to state and I WANT TO HELP YOU - just know that the pay you received is all you get!. HOWEVER- there is sooo much more to this-- i just hope you havent been back to work!

the reason why I know this information is because I have been on comp for 20 yrs!. i have 'been there, did that and the battle continues!.!.!.


I think there is something to be said about your Manager, He was were wrong!, but why was there no-one holding the ladder !.!.!.

How are you doing now!? Don't know why the doctor would release you back to work if you have a serious injury!. Maybe you need to get a second option from a different doctor!. You need to get an Attorney who deals only in Workers Compensation!. If you have a serious injury that is causing you to not to be able to work you will need an attorney!. If the attorney thinks you have a case, they will take it and not charge any money up front!. Good Luck!.Www@Answer-Health@Com

I agree if you had a doctor's note saying you were capable of doing "light duty" than you have the responsibility to show up for work and do tasks that you can do!. That is just the way it works!. However, why come here and seek help, call and set up a meeting with a work comp attorney, most will have a free initial consultation and get the facts for you state and see if you have a case!.Www@Answer-Health@Com

If your doctor said you could return to work with restrictions, then workman's comp considers the case closed and you get no more benefits!.
