Question: I fell down the escalators at a mall 3 years ago and broke my collar bone!. Can I sue now!?
I fell down the escalators at a mall!. They were turned off but did not have any non lip surface on them!. I fell from the second step and fractured my collar bone!. I spent about 3 days in the hospital, but my collar bone has been botherin my ever since!. I didn't sue when it happened cause I was under 18 and my dad didn't want to!. Can I sue now!?Www@Answer-Health@Com

I'd say a lot of it would depend on the statute of limitations in your area!. Also some important pieces of evidence you'll need would be any photographs of the area such as were there signs up telling you to keep out or were they cordoned off!? Were there any spills or such!? Were you wearing shoes that may have contributed to you slipping!?

You'll also need some of your medical records such a s X-rays and hospital bills!.

Sure, this is America where anybody and everybody sues for any reason they see fit!. Get a good lawyer! That's the only way you're going to get anything is if you have a cut-throat lawyer!. So that way if you do get a settlement, you will have to pay your lawyer at least 40%!.

You should think long and hard before you do something like this!. It's a bad idea!. If the escalators were off, then you should not have been on them!. And that's only a small piece of what the defending team of attorney's are going to say to you!. Your chances are slim of getting any type of compensation after this long, especially since you were under the care of your parents at the time of the accident!. The other side is going to rip you apart and try to portray you as someone who is only after money!. Judges don't like that!.

Maybe, but, in your locale, has the statute of limitations run out (too long after the accident to first file a lawsuit)!? Can you "prove" the mall was negligent and that it was not your fault!? Do you have copies of your hospital records and bills!? You might have to find a local personal injury attorney and ask him/her; they often give a free initial consultation and then wind up taking about 50% of any monies you might ever be awarded by the court!.Www@Answer-Health@Com
