I went to the gym where I am a member for the first time in a while today, and am quite confident with using all the old machines that I used to use there!. There is this one machine that I wasn

There was a sign posted to ask for help you did attempt to get help but was not able to get the help you needed you decided to still use the machine even though you knew you did not have proper knowledge of it and got hurt!. Now you want to sue the gym!. This is what is wrong with America today nobody wants to take responsibility for their own actions!.Www@Answer-Health@Com

How about you take a little responsibility for yourself and stop trying to blame everything on everyone else!. You're probably out of shape, that's why you are hurt!.

I strained my latissimus dorsi two days ago in my gym becuae I was lifting too heavy without a spotter but you don't see me pointing fingers!.

All gym membership contracts should have a clause that states you assume full responsibility for injuries that weren't caused directly by a gym employee, or indirectly if you were told incorrectly how to use the machine!.Www@Answer-Health@Com

I'm sorry to say this, but your at fault!.

Because it stated that you should know how to use a machine before actually using one!.

Even if you asked a member of staff who wasn't kowledgable, that doesn't mean he is qualified to train you in using that machine, yet you used it regardless!.

Sorry but you do not have a case in this situation!.

If a fully licensed trainer told you how to use the machine adn the trainer was incorrect, then you'd have a case, but a member of staff at the Gym does not hold this responsibility!.Www@Answer-Health@Com

I sympathize with you and I hope that you haven't hurt yourself too badly but I do have to say that I really hate to see people always trying to find someone to blame when something goes wrong!.

I don't wish to come across as harsh but the fact of the matter is that, if you didn't know how to use the machine then you shouldn't be using it!. If there was not enough staff around to assist you, then you should have either used a different machine, waited until someone could help you, or made a formal complaint about the lack of service!. If you did this and got nowhere, it's time to change gyms!. You made the decision to go ahead and use the machine anyway even though you knew that you didn't know what you were doing!. Therefore, assuming you are not a minor, it was ultimately your responsibility!.

Yes, you may be able to sue the gym in court, perhaps even successfully (though I doubt it since, as someone else has already stated, you probably signed a waiver when signing up) but, if you ask me, you have no moral right to do so!.

In the old days, people took responsibility for their own decisions and just sucked it up and dealt with the consequences if those decisions turned out to be poor ones!. Tort law was there to protect you from serious disadvantage resulting directly from genuine negligence!. It was not the financial equivalent of a cookie to make the boo-boo better that it has turned into today!.

The growing trend in westernized countries, especially the US, of emphasizing the rights of the individual while de-emphasizing their responsibilities is, I feel, a large contributor to the breakdown of society!. People will accept little or no limitation on their freedom to take whatever risks they like but expect someone else to pay for the consequences of those risks when things go bad!. Not only is this is a non-sustainable situation, it is also breeding generations of people who are ill equipped to take responsibility for their own actions!. We used to have a name for people like this, "children"!. We are breeding generation after generation of children who will grow up to simply be older children and that's a situation that benefits no one!.
