Question:

If you went to a new Doctor and he refused to treat you because you have HIV, what would you do?

I did a change of Doctor/Provider with my HMO Insurance. I have several medical issues that have been on going and two which needed immediate attention so I put it all in writing. On May 10th, 2007 I arrived on time and handed him three pages-the first listed my immediate medical needs which had three issues the second one being severe pain in my upper back/lower neck area and pain that radiated down my left arm. As he read, he turned to the second page, saw that I am HIV+ & he then freaked out. He told me I needed a specialist and that I should call my insurance company and get a specialist-he then handed me my co-payment back. I called my insurance company and they verified my story by calling the doctor what he did but they refused to let me change providers until June 1st. The pain got so bad that I screamed into a pillow-3 times during 1 day. I went to Emergency two times before they got the pain under control. I now have lost feeling in my left arm. Do I sue and for how much?


Answers:

Jewish Attorney--from the biggest town near you---and I'm not kidding---as a PROVIDER for that HMO insurance-- he legally CANNOT REFUSE treatment---and he did-- your lawyer will be able to sue the doctor as well as the HMO because they should've referred you immediately to another physician for your illnesses. And don't laugh about the Jewish part---I have found that they make the best attorneys because they are so "tuned" into the monetary value. Also make sure your attorney is from out of the area--you do not want a lawyer who plays golf with the doc you're trying to sue (that happened to me by the way) so get one from the biggest metropolis near you--hopefully, NYC, Chicago, Philadelphia, Boston........

Good luck to you, I hope everything works out for you and I am sorry that you were treated so inhumanely---what a world we live in------by the way----get a large notebook that is bound---you can't rip the pages out---document everything that happened starting with day 1 and list the names of the people and the dates---and also document your symptoms and which dates how long you had the pains, who you called, who you talked to and gave you no help, who you saw in the ER get the ER notes, etc.....you get the drift---if you start the leg work for the legal action BEFORE you see the attorney- you will have more to show him than just telling him things from your memory---I don't know about yours, but when I'm upset I can barely remember MY name.........good luck..........I hope you get millions..........and if the attorney doesn't bring up the HMO suit-- YOU bring it up......you are supposed to have continued quality care---they are liable for not providing such.
