Is there standard award for pain and suffering for a minor injury sustained in a department store?

I fell in a Lowe's department store and hurt my knee. I incurred medical costs of 16,000 for surgery, etc. But I need to know how much to ask for above that amount for my trouble.


Answers:

You only want to ask for a set price if your certain that you won't need further medical treatment. And you have to medically released by a doctor. If you haven't been released by the Doctor or they're certain you'll need more treatment then you can't settle the lawsuit. Or, better yet, you don't want to. Once your awarded a claim against them you can't go back and sue them again if your bills should exceed the amount won.

You failed to mention if you contacted Lowe's Mgt. I can GUARANTEE you, if you didn't contact Management that day or within about a three day grace period.... your screwed. The judge will tell you that you waited to long and dismiss the case.

This is so you can't get hurt at your home and then try to blame a store for it.
