Question:

I had a small adhesion taken off my bowel and the Dr.cut my bladder accidental.17 stitches,can i sue?how much?

The surgery was supposed to be a laposcopic day surgery and was only supposed to be two small holes. He nicked the bladder and it opened up to a wound that took 17 stitches to close. He had to call in another surgeon (urologist) to finish my surgery and it took 40 minutes to find one. when he came out and spoke with my mother, he told me he made an "oops" but the good side was that he raised up my bladder. He never said he was sorry or made any mistake. I had a catheter in my bladder for 10 days very much pain and a high fever afterwards. I am still in alot of pain and all the meds are making me awful nautious. after I went home and called him and told him that I was in alot of pain. He seemed very condescending toward me and told me that I shouldn't be in pain after a week. When I went to see him to get staples out, he was sooo nice and appologized soo many times, it was kinda weird but I really didn't say anything to him about the screw up but people have told me to sue .


Answers:

I'm sure you could sue. I bet you'd have a case.

However, you have to remember the power of the doctor while also remembering that they are humans and make mistakes. I am not condoning the accident or discounting you in any way, but these are people of high respect and stature. So just be careful if you do.

My suggestion?

Hang on to every thing and request copies of your medical reports.

If you are healing and feeling better, I would chalk it up to an bad experience.

If you get sick again or aren't getting any better or still in pain? Get it documented that you are keeping appointments, being checked out and get copies of those records as well. Then sue.
