How do I find a comapany to help me sue for medical negligence?!


Question: Following the birth of my twins it seems that my c section was messed up with the membranes being left in, getting infected etc. I have now had to have further surgery to remove them and am looking into the possibility of suing. Does anyone have any advice on choosing a solicitor/company to represent me - what should I be asking? Thanks xx

Check the papers you signed, because a lot of things can happen during surgery and the OB and the hospital had you sign an informed consent saying you understood the risks. This might be one of the risks you signed to. Also to sue, you are going to have to prove the Dr was doing something really wrong, like not following any of the standard procedures, or being drunk or high. It sucks when it happens to you, but not every surgery goes perfectly. Sorry that you had a bad experience, but lawsuits aren't always the answer, and people suing over stuff they shouldn't but doing it anyway to try and get money (not saying that's what you are doing) is one of the big reasons health care costs as much as it does.

There's a little bit of implied consent since you went through with the operation, but them not explaining the procedure's risks is a big deal. And based on what you were told by the surgeon who removed the membranes my suggestion would be to find a reputable lawyer who can help you draw up a formal complaint against the surgeon who messed up and request a refund of all your hospital expenses at that hospital as well as compensation for the corrective surgery. The lawyer will probably know how to word it so that it's left open for any further complications that might arise. The hospital would probably oblige since it would be much cheaper than settling a lawsuit, and they should take the complaint seriously coming from a lawyer so hopefully it will result in disciplinary action against the doctor.
I don't work in a hospital, I'm just a dental hygienist, but I have a lot of friends and family in the medical and dental fields. So my first reaction is always to bristle when people talk about lawsuits since the general public doesn't take into account the complications that arise in individual situations that the doctor has no control over. But I'm not blind to the fact that there are some doctors out there who really do awful things.
