Question: Can i sue my doctor!?!.!.!.!.!.!?
I starting going to my doctor two to three years ago with some extreme symptoms, my doctor was male and as this was a female problem he didn't seem to understand just how much these symptoms were affecting my everyday life!.
I was in constant pain and had constant bleeding between periods, fatigue, painful intercourse, bloating,back pain etc etc!. These symptoms made my life a misery, he changed my contraceptive pill on and off for 2 years!. That was all he would do for me and it made my symptoms worse!
One day my doctor was off ill so i seen a female doctor instead, she listened and looked at my medical notes, she was shocked the male dr had done nothing to help me!. She reffered me to a gynacologist that day!. After 3 weeks i was put in hospital for a laparoscopy, it showed i had stage 2-3 endometriosis!. My endo was lasered off but came back only 4 months later!. Now i am infertile, my endo has spread to my bowel and my hair is falling out! can i sue the male Dr for taking so long!? The question you are asking is, "was my doctor negligent in not diagnosing my endometriosis and could a timely diagnosis have prevented my infertility"!.

These questions are not easy to answer!.

If you think this is the case then what is the next step!? First you must ask yourself what you expect to gain by starting a lawsuit!. Is it to punish the doctor!? Is it to feel closure!? Is it to achieve revenge or to prove that he is a "bad" doctor or to get money!? Suing may or may not provide you with what it is you need to accomplish!. There may be other ways!.

If you do decide to pursue a law suit and you are able to find a lawyer who believes in your case, then you are in for a very long, potentially expensive and very emotional process!. Most lawsuits don't reach conclusion until many years have passed!. The end result, even if you win, may not make you whole, emotionally or financially and may not provide you with closure!.

Also you must realize that for you and the doctor this is a very emotional undertaking!. For the lawyers and insurance companies it is 100% business!. What makes sense from a business view may not mesh what makes sense to you emotionally!.

What usually happens is that a person will go to either a malpractice lawyer or personal injury lawyer and explain what happened!. That lawyer will not know anything about the medical aspects of the case or that your case is winnable!. He/she will get your medical record and send it to another doctor (the "medical expert") for review and an opinion!. He/she will also file the case in court protect against an expiration in the statute of limitations!. This all costs money and you will most likely foot the bill, as the lawyer doesn't yet know if the case merits investment of his law firms finances!.

If the lawyer, after all this, decides to take your case, beware if the case is not accepted on contingency!. If the lawyer takes the case on contingency that means you are billed nothing win or lose, the lawyer just takes a percentage of the award if you win!. If the lawyer doesn't take it on contingency then he/she doesn't believe the odds of winning favor the law firms money and you will be expected to finance the case, including all motions, depositions etc!. This is where emotions may cloud judgement!.

Also, if the lawyer likes the case but doesn't have the experience or wherewithal to bring the suit himself he will refer it to someone who can!. What he wont tell you is that the new lawyer will get 33% of your award and the original lawyer gets 10% of your award!. This is one reason why even if you do win, if the award isn't that big to begin with then you will have spent 5 years of turmoil and emotional pain and stress, and money and may end up with a lot of money, or closure to have made it worthwile!.

I most agree that a doctor should have at least been aware of the problem and had you referred to a specialist "Gynecologist" for these problems if he felt on unfamiliar grounds!.
My wife doesn't see any mail doctors with female problems, but finds or sets up an appointment with a female Gynacologist that understands the problems and does something about it!.
You mentioned that you were seeing this other doctor for two to three years!. If I had some concern about the doctor ability I would have taken it elsewhere!.Www@Answer-Health@Com

Yes and please do for all of us!. am going thru somewhat of the same problem the only doc i can see is a male and he gave me a birth control pill and nothing has helped so if you found out what was wrong and he didnt doo anything thats malpractice take him for all hes got!.!.!. mebbe if they had caught it earlier it wouldnt have been as badWww@Answer-Health@Com

Yes you can and you should especially if you are now infertile because of the lack of a proper medical diagnosis!. File a complaint with your states board of medical licensing!.Www@Answer-Health@Com
