It could be, it depends:
Just because a person has Down's Syndrome doesn't mean they're not capable of consent, but it might - it depends on a number of factors that your son won't be aware of, like what her actual IQ is, whether or not they've actually been tested as competent or incompetent. (Last time I checked, and it's been a while, someone had to be below IQ70 to be retarded - and even then they COULD be capable of consent).

That being said, how old are the girls? In the State of New York, (in 1995 or so), I vaguely remember something from the NYS Penal Code that said something like someone from the ages of 15-16 could have sex, legally, with anyone else in that age bracket - but I'm not sure, that was 16 years ago, and only in the State of New York - in your jurisdiction the laws may vary. (You should hear what they are in South Korea!)

I have mixed feelings as an adult, as I have no children yet, but I do congratulate him on getting some tail at 16, especially if he's ugly. But beating him is not a good idea - especially at 16, he's too old for that and could probably overpower you - if he can't, he will be able to soon enough and you might have legal consequences. Besides, it's just not the right thing to do.
