If a company sells a Generic O.T.C. drug, does that mean the original patent for the drug has expired?
So i can sell the same drug for an alternate purpose without FDA approval?
Answers:
It means they still have patents for their brand but other companies can now use the same formula, meaning they dont have exclusivity rights anymore because they expired but all generic otc pills and chemical drugs need FDA approval to be sold.
