What's the law on the transfer of dental records without patients knowledge!


Question: What's the law on the transfer of dental records without patients knowledge?
I tried to call my dentist for a copy of my records & x-rays, and they had suddenly closed. Another dentist office 'retrieved' all of the records. When I asked to get them, they said they had them (literally right in the hands) but I couldn't have them. I had to wait 7-14 days for copies. I never gave them permission to have them in the first place and I don't want them to have them.
What's the law on this? (I'm in New York if that matters.) Can the legally have them and not hand me the originals?

It all depends on whether or not you signed a records waver in either office....If you did you have no grounds....As for the originals, you are not entitield to originals as they are the dentists diagnostic tools which he must retain and keep on file by law. However you are legally entitled to copies of your records, and he by the way can charge a fee for the copies. Good luck and I wish you well.

If the office has been sold to another dentist, than all the patient records are transferred too. I am not sure about the legal issues in your case, It would be better that you seek advice from New York attorney.
