...underdeveloped arms uses her feet to do
just about everything including driving her car. She went to a McDonald's restaurant, placed her order at the drive-thru, then when she pulled up to the window she was denied her food because she was using her feet to grab the bag. She is now suing McDonalds for $4,000,000.

In my opinion, this is clearly a case of blatant discrimination. I was totally outraged that it could even happen. Okay, the worker is probably young and inexperienced, but one would think that she would have been trained at least well enough to know that we must treat people with respect. Where was the manager? Oooh, I guess I'm a little fired up about this. What is the other side of the issue? Feet instead of hands? Is it a hygiene issue? I'm sure she keeps her feet at least as clean as the average American keeps his or her hands.

I hope that she wins and I hope that it sends a very, very clear message to people that it is not okay to refuse service to someone just because he looks different, talks differently or uses feet instead of hands. She is certainly not the only person in this country who has learned to use feet where hands are not functional. I think it's absolutely amazing that she has learned to use her feet like that and do everything she needs to do. She is not presenting herself as someone who deserves anything more than any other person. She just deserves the same as everyone else.



But I don't think that's the point. Several employees must have dropped the ball on this one; if there are stringent sanitation laws in place to prevent people from handling their own food with their feet, the employee could have placed it in the car for her, or simply washed their hands after handing her the bag. I suspect the ADA might have some sort of provision that requires some sort of access to food for her.

This is unfortunately what comes of having minimum-wage employees who are trained by rote on regulations, and fired at a whim. Common sense doesn't have any leeway in deciding what to do in non-standard situations. 9 times out of 10, the rule is good- so you don't get jerks coming through the drive-thru harassing the employees with their dirty feet, but the one lady with a legitimate disability shouldn't be subject to that rule- at the very least, a manager should have taken control of the situation and used some common sense.

Litigation is one effective tool in our society for getting the word out about random problems like this, and it will undoubtedly result in a settlement and possibly a little more common sense in the drive-thru. It's more than that lady deserves- she really deserves only the refunded price of her meal and, while I wouldn't want to try to put a price on the loss of face or dignity by the refusal to serve her, it doesn't add up to $4 million. Maybe $500, tops. The greater good here is the fact that the corporation will be stirred to action, in some small way.



now, several things seem silly in this story to me. I can't imagine why they would care how you get your food at McDonalds, especially when it's at the drive up. That makes no sense to me. If someone pays for their food, doesn't appear to be violent or disorderly, I can't imagine why McDonalds would care how the customer reached for her food. The person at the drive up would have noticed her underdeveloped arms, I would assume, and would realize that she was compensating for the arm situation by using her feet, and was probably using her feet for her driving, also. Did they think this was just a gag by someone, perhaps, giving them a hard time and just using her feet as a prank? That is possible, I suppose, that they blew it all off as a prank. Without being there, without seeing the whole story, it's hard to know how to react to this story.

If the drive-up employee had a problem with it, seems like they would have contacted the supervisor and the supervisor would have remedied the situation (unless this McDonald's only employees idiots!). If this did happen as stated, then somebody needs to look at McDonald's policies and make sure they are clarified.

I'm sure this is true, or you wouldn't have posted it, but would you also post a link to the article where you read this online?

On the other hand, for her to sue McDonalds for $4 million over this is just as rediculous. How was she affected that much that it would be reasonable to compensate her 4 million dollars?? It makes absolutely no sense to me! People have to stop suing people for looking at them in the wrong way! It's getting a bit rediculous!



I bet she keeps her feer cleaner than most people keep their hands!

That is in excusable, if the lady can drive and has been cleared to drive, for mc donalds to not give her food is a terrible thing!

there is no doubt in my mind that she will win that money, and i am surprised she didn't sue for me to be honest!



It's unbelievable that they wouldn't be willing to waive whatever ordinance they had in place. At the very least they should have been willing to bring it out to her car and put it in for her.



I feel bad for the girl, she should sue mcdonalds! She better win!
